Terms of Service

Please read these terms carefully before using the Pharmachub service. They set out the legal agreement between you and Pharmachub.

Introduction

These Terms of Service ("Terms") govern your use of the Pharmachub website (pharmachub.co.uk) and clinical pharmacy service ("Service"), operated by Pharmachub Ltd ("Pharmachub", "we", "our", "us"). By accessing the Service or creating an account, you agree to be bound by these Terms. If you do not agree, you must not use the Service. We may update these Terms from time to time. Material changes will be communicated to you by email or dashboard notification. Continued use of the Service after any change constitutes acceptance of the updated Terms.

Eligibility to use the Service

You must: • Be at least 18 years of age • Be a resident of the United Kingdom • Provide accurate, complete, and current information when registering and at all points during your consultation • Not have been previously suspended or removed from the Service You must not use the Service on behalf of another person without their explicit consent and must not submit false or misleading health information. Doing so may constitute a criminal offence and could put your health at risk.

Nature of the clinical service

Pharmachub provides access to a UK-regulated online clinical pharmacy service. The Service connects patients with UK-registered prescribers who carry out individual clinical assessments and, where clinically appropriate, issue NHS-exempt private prescriptions. The Service is not a substitute for your NHS GP or emergency healthcare. It does not constitute ongoing medical care for conditions beyond the scope of our clinical service. We do not provide urgent or emergency medical advice. A completed consultation does not guarantee a prescription. Eligibility is determined solely by the assessing clinician based on your individual clinical information.

Your account

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately if you suspect unauthorised access to your account. You may not share your account with any other person. Your account is for your personal use only and may not be transferred. We reserve the right to suspend or terminate your account if we have reasonable grounds to believe these Terms have been breached, or where required for patient safety.

Prescriptions and payment

Where a prescription is issued following your consultation, you will be notified by email and through your dashboard. Payment instructions will be provided at that time. Payment is required before your medication is dispensed. We currently accept payment by bank transfer. Prices are confirmed prior to payment and include the cost of the consultation, any prescription fee, and medication. Prescriptions issued through our Service are private prescriptions and are not eligible for NHS prescription charge exemption unless you otherwise qualify. You are responsible for checking your eligibility for any exemptions. We reserve the right to cancel a prescription if we are unable to verify payment, if the medication becomes unavailable, or if a subsequent clinical review determines the prescription is no longer appropriate.

Delivery

Medication is dispensed from our GPhC-registered pharmacy and delivered by a tracked courier to the address provided during registration. You are responsible for ensuring someone is available to receive the delivery or that a safe delivery arrangement is in place. We cannot accept responsibility for delays caused by third-party couriers, incorrect addresses provided by you, or circumstances outside our reasonable control. If your medication is not delivered within the expected timeframe, contact our team through your dashboard.

Refunds and cancellations

Consultation fees are non-refundable once the consultation has been reviewed by a clinician, regardless of outcome. If a prescription is cancelled by us before dispensing, you will receive a full refund of any payment made for that prescription. Once medication has been dispensed, we are unable to offer a refund for reasons of clinical safety, unless the medication is faulty, damaged, or incorrectly supplied. In such cases, please contact us within 48 hours of receipt. Your statutory rights under consumer law are not affected by these Terms.

Acceptable use

You must not: • Use the Service for any unlawful purpose • Submit false or misleading health information • Attempt to obtain prescription medication for resale or supply to another person • Interfere with the security or integrity of our platform • Use automated tools to scrape, copy, or extract data from our Service • Impersonate another person or entity Breach of these provisions may result in immediate account suspension, reporting to relevant authorities, and legal action.

Limitation of liability

To the fullest extent permitted by law, Pharmachub shall not be liable for: • Any indirect, consequential, or incidental loss arising from use of the Service • Loss or damage arising from your failure to follow clinical advice or the instructions included with your medication • Any inaccuracies in information you provide during your consultation Our total liability to you in connection with the Service shall not exceed the amount paid by you for the relevant prescription or consultation giving rise to the claim. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Intellectual property

All content on the Pharmachub website and platform, including text, images, logos, design, and software, is owned by or licensed to Pharmachub Ltd. You may not reproduce, distribute, or use any content without our prior written consent.

Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
